VILLA SURIN RENTAL TERMS AND CONDITIONS

BOOKING, PAYMENT and CANCELLATION POLICY

1. BOOKING  
 

A rental offer for the villa will be held for 5 days pending receipt of a booking deposit equal to 50% of the total villa rental fee due.

A booking will only be deemed confirmed once Villa Surin has received the booking deposit.  The balance of any rental fee due must be received no fewer than 45 days prior to the date of arrival.  Failure to pay the balance within this time may lead to the booking being cancelled and to forfeiture of the deposit.

For bookings made fewer than 45 days from the date of arrival the booking will only be deemed confirmed once 100% of the villa rental fee is received.

All bank charges are at the expense of the booking party.

2. CREDIT CARD PAYMENTS  
 

Villa Surin is able to accept all major credit cards through Paypal. In the event of any dispute of a credit card payment knowingly made through Paypal, the credit card payee agrees that such disputes will be resolved directly with Villa Surin’s management and not through Paypal’s internal dispute resolution facility, and in so doing the credit card payee consents for paypal to release all funds to Villa Surin.

3. CANCELLATIONS  
 

If for any reason you decide to cancel your booking we will do our best to reschedule your stay to an alternative date within 60 days of the date of the original booking (NB the same rates quoted for the original booking may not be available for the new dates chosen).

If mutually acceptable alternative dates are not available then any rental monies paid (less fees and agent commissions) will be returned up to the extent that we are able to recover that sum from a new booking made for the same rental period.  Otherwise 50% of the full rental fee will be forfeited for cancellations made more than 45 days from the start of the rental period and any monies paid will be forfeited for cancellations made fewer than 45 days from the start of the rental period.

In the event that a booking has been made by credit card through an intermediary agent such as paypal, the credit card payee agrees that the intermediary will release all funds to villa surin, will not use the intermediary to dispute these transactions and that any funds to be returned to the payee will thereon be made directly by Villa Surin Management via bank transfer. Credit card processing costs will be considered the responsibility of the credit card payee in such circumstances.

4. CHECK-IN/CHECK-OUT  
 

Normal check-in time is 2pm.  Normal check-out time is 11am.  Should guests require an early check-in or a late check-out please enquire since these will usually be possible.  A late check-out fee of $350 will be applied for check-outs between 11am - 5pm and $600 for check-outs between 5pm - 9pm.  Check-outs after 9pm will be charged a full additional day’s rental fee.

5. PASSPORTS  
 

Villa management will take a copy of each guest’s passport at the time of check-in.

6. SECURITY DEPOSIT  
 

A fully refundable security deposit of US$1,500 (or equivalent) for every week or part of week of the total rental duration must be paid by bank transfer prior to the start of the rental period.  The deposit will be returned by bank transfer initiated within 5 workings days of the end of the rental period (outgoing bank charges will be paid by Villa Surin) after an inventory check and subject to any deductions for breakages or any unpaid bills. 

Any damages in excess of the amount of the security deposit remains the responsibility of the lead parties and must be paid promptly.

7. INSURANCE  
 

It is a condition of the rental booking that all guests have fully comprehensive insurance which covers all aspects of health and travel in Thailand including accident, illness, disease, full medical assistance, repatriation, legal assistance, theft, loss, cancellation of holiday, delays, missed flights etc..  Villa Surin can accept no liability for any disease, injury, loss, theft or other harm contracted or incurred by guests using the villa, any equipment therein or the villa vehicles.

8. RESPONSIBILITY  
 

At the time of check-in the group must designate one or more persons as the lead party/parties which person(s) will be fully responsible for the behaviour and any expenses incurred by all other guests in the group..

SERVICES

9. AIRPORT TRANSFERS  
 

The villa rental rate quoted includes airport or seaport arrival and departure transfers for all guests arriving and departing on the same flights or boats.  Additional transfers at different days or times will be charged at local taxi rates.

Guests are advised to allow - in addition to airline requirements - at least one-and-a-half hours for the return journey to the airport.  (Airport journeys usually take 30 minutes, but heavy traffic, adverse weather or airport security queues may add considerable time to the trip).

It is the responsibility of the guests to give villa management at least 24 hours notice of departure times.  Villa Surin cannot be held responsible for flights missed due to inadequate journey time being allowed.

10. BABY-SITTER  
 

If required a baby-sitter can be proposed.   Any baby-sitting arrangement is made directly between the parents and the baby-sitter and Villa Surin cannot accept any responsibility for these arrangements or their outcomes.  Under no circumstances can Villa Surin Staff accept responsibility for looking after minors.

11. BREAKFAST  
 

Complimentary continental breakfast is provided between the hours of 8am-11am.   Cooked and Thai breakfasts are also available from the villa menu at additional charge.

12. CAR HIRE  
 

For guests who require additional mobility Villa Surin can assist with local car hire.

13. CHAUFFEUR SERVICE  
 

Between the hours of 8am-5pm a complimentary shuttle service to and from Surin Beach is included each day. Should guests require the service for other areas of the island and outside these hours than subject to availability the Villa Surin will make arrangements to accommodate.

14. CHEF  
 

For those guests so requiring a full-time chef can be arranged (subject to availability and at additional rates).

15. INTERNET  
 

Free unlimited wireless internet is provided in the villa.

16. GYMNASIUM  
 

Villa Surin is proud to offer a fully equipped commercial standard gymnasium for use by resident adult guests.

17. KITCHEN  
 

A fully equipped western kitchen is at the complete disposal of villa guests.

18. LAUNDRY  
 

An in-house laundry service is available for guests and will be charged at published villa rates.  While maximum care will be taken with all items of clothing please note that the maximum liability accepted by Villa Surin for any individual item is limited to the laundry fee for that item.
We regret that for reasons of safety guests may not access the laundry area.

19. LINEN CHANGE  
 

Rates include towel and bed linen change which will ordinarily be made every 4 days.  If necessary, more frequent changes can be made at a charge of 500 baht per bed per change.

20. MAID SERVICE  
 

The normal villa maid service consists of two maids and is available between 8am and 5pm, 7 days a week. Extra maids or a live-in maid service are also available.  These options need to be arranged in advance and will be subject to additional charges.

21. MASSAGE and SPA TREATMENTS  
 

A full range of in-house massage and spa treatments is available and can be booked in advance by guests.  Please enquire about costs.  Please note that for reasons of security Villa Surin cannot accept on the property any unapproved person charging for services.

22. MEAL SERVICE  
 

The villa cook will be able to prepare breakfast and lunch items from the villa menu at published prices.  The cook may also be able to prepare other dishes: please enquire.  If a cook is needed after 6pm then her time will be charged at 100 baht per hour or fraction of hour.

23. MOBILE PHONE  
 

For the duration of the rental guests can be provided with a mobile phone with which to contact the Villa Manager in the event of any problem.  Starter credit will be put on the telephone and additional credit may be purchased by guests from any convenience store (alternatively the villa staff will be happy to assist with this).  The mobile phone needs to be returned at the end of the rental.

24. MOTORSCOOTERS  
 

Motorscooters are available for hire by guests.   To use them a full driving licence is required by Thai law.

25. SAFES  
 

Personal safes are provided for the storage of small items.  If required please ask the staff for a demonstration of how to use them.  It is the responsibility of guests to leave any safe used open at the end of the rental.  A charge of up to $250 to replace the safe and for repairs to walls and fittings may be levied for any safe left closed and for which the password has been forgotten.  Villa Surin cannot accept responsibility for forgotten passwords.  Larger items can be left for safe keeping with villa management.

26. SATELLITE TELEVISION  
 

Free satellite television is provided throughout the villa.

27. SHOPPING  
 

A food and drink shopping service is available.  All shopping will be charged at cost price but subject to a 12.5% service charge (50 baht minimum).

28. TELEVISIONS and DVD PLAYERS  
 

Flat screen televisions, DVD players and iPod docks are provided in each of the principal bedrooms and in some of the communal rooms.   Unfortunately electronic equipment in tropical climates tends to have a short life and occasionally an item will need to be repaired or replaced.  If there is a problem with any electronic item please inform Villa Management but be aware that repairs may take some time so in the event please use one of the many other televisions, DVD or iPod docks located throughout the villa.

29. UTILITIES  
 

The quoted villa rental fee includes all water, electricity and gas consumed subject only to reasonable use.  Excessive utility consumption caused, for example, by air-conditioners left running in rooms with open doors or windows or left permanently on in empty rooms, may incur supplementary charges.

SPECIAL REQUESTS

30. BEDS  
 

The layout of the villa is contained in the room descriptions and floor-plans.  These should be consulted prior to making a booking.  It is the responsibility of guests at the time of booking to assure themselves that room sizes and configurations are suitable and comfortable for their purposes and to inform villa management of any special sleeping arrangements required.  Villa Surin regrets that room arrangements not communicated prior to arrival might not be able to be satisfied.

Please note: Bedroom 1 is normally configured with a large double bed but a cot could be added.  Bedroom 2 is normally configured as a double bedroom but could fit an additional double bed or 2 more single beds, alternatively it could be configured with 3 single beds.  Bedroom 3 is normally configured as a twin bedroom but could fit an additional single bed.  Bedroom 4 is normally arranged as a double bedroom but could fit an additional small single bed or cot.  Bedroom 5 is a small double room and no beds can be added to it.  Bedrooms 6 and 7 are small single rooms and no beds can be added to them.  Bedroom 8 usually has a double bed but can be arranged as a dormitory to fit up to 5 single beds.

Unless otherwise specified the bedrooms will be configured with the normal number of beds.

31. DIETS and ALLERGIES  
 

Please inform Villa Surin of any special dietary requirements or allergies prior to arrival.  It is especially important with regards to shellfish and nut allergies since these two ingredients are a pervasive part of Andaman cuisine.

32. OTHER REQUESTS  
 

Villa Surin will be delighted to arrange any special requests: birthday cakes, Christmas parties, Thai banquets etc..  Please let us know at the time of booking.

HOUSE RULES and GUEST OBLIGATIONS

33. ACCESS  
 

Villa owners and their staff and representatives retain the full right to access any part of the villa at any time.

34. ADDITIONAL GUESTS  
 

The villa rental rate quoted is valid for the number of guests agreed in the rental offer.  Subject to advance notice, and at the discretion of management, additional guests may be added to the booking and may be charged a supplementary fee.  Additional guests (including infants) who present themselves at the villa without prior notice will be admitted to the Villa only at the management’s discretion and charged a fee of $200 per additional guest per night of the rental. No discount is applicable should fewer than the agreed number of guests at the time of booking use the villa.

35. BREAKAGES & LOSSES  
 

It is the lead party’s obligation promptly to report breakages to or losses of Villa property.  Breakages or losses reported and paid for immediately will be charged at cost, those which are not reported or are discovered at the end of the rental period will be subject to a 50% administration charge to cover the additional costs of express repairs and replacements.

36. EXPENSES  
 

Guests may leave money with Villa management on account to cover incidental expenses.  Any monies unused will be returned at the end of the rental period or at any stage requested.  If guests choose not to create an expense account then any additional bills need to be settled in cash on the day that they have been incurred and cannot be put on account or set-off against the security deposit.   In the event that bills are left unpaid for more than 24 hours Villa Surin regrets that no additional expenses can be charged by any guests until all bills are settled.

37. EXTRAORDINARY CLEANING  
 

Where as a result of festivities or other guest activities the villa requires extraordinary cleaning this will be charged at a rate of $300 per cleaning in addition to the costs of any damage to the villa fabric or garden.

38. ILLEGAL and ANTI-SOCIAL ACTIVITIES  
 

No illegal activities may be conducted on the villa, nor may illegal items or substances be taken onto the villa.  Guests are required not to engage in any anti-social behaviour nor to cause nuisance to neighbouring residents.   Breaches of this term could result in police intervention and/or termination of the rental agreement without any right of refund.

39. INFANTS  
 

Guests should note that some parts of the villa common areas including stairs, balconies and the swimming pool may constitute a risk to unsupervised infants or small children.  It is the guests’ responsibility to ensure that infants and small children are supervised at all times.

On advance notice the villa can provide high-chairs and cots (charged at 250 baht per cot per night).


40. LIGHTS and SECURITY  
 

Guests are asked to ensure that lights, including the pool and garden lights, and the water features are switched off at night and that the villa is kept locked at any times when there is no one present.

41. OUTSIDE GUESTS  
 

Non-resident friends are welcome to visit the villa but for reasons of security we are not able to accept any overnight stays from people who are not part of the original booking unless this is cleared in advance with Villa Surin management and any necessary supplement is paid.

42. PETS  
 

Please contact us if you wish to bring your pet to the villa.  We will try to accommodate your request.

43. PROBLEMS and COMPLAINTS  
 

Villa Surin is committed to making your holiday as enjoyable as possible, if any problems arise please inform the staff or the Villa Manager who will then immediately attempt to remedy them.

We regret that complaints made after departure or made on the morning of departure and which cannot reasonably be rectified prior to departure will not be considered.

 

44. RESTRICTED AREAS  
 

The rental agreement allows full use of the villa with the exception of the roofs and restricted service areas to which entrance is not permitted.
 

45. RESTROOMS  
 

Please do not throw any items into the toilet other than the toilet tissue provided.  For other items please use the hygiene bins provided.

46. SMOKING  
 

Guests are welcome to smoke in any non-enclosed parts of the villa (open areas, terraces, gardens) but are asked to refrain from smoking in any of the rooms or enclosed parts of the villa.

47. TAXIS  
 

Guests are welcome to use external taxi services for journeys to and from the villa but should note that tuk-tuks are unlikely to be able to make it up the hill.

48. TIPPING  
 

The villa rental rate quoted includes service charges but guests are welcome to leave gratuities for the staff.  Unless specified to the contrary all such gratuities will be divided equally among all the staff.

49. VILLA HOURS  
 

The villa and estate is open to guests 24 hours a day however guests returning late at night are asked to be mindful of other residents in the estate.

50. WHEELCHAIR ACCESS  
 

We regret that because of the layout of the property Villa Surin is not suitable for persons with impaired mobility.

51. WOOD FLOORS  
 

Thai custom requires that shoes are removed indoors.  Whilst much of the villa has stone floors we ask that guests take care of those internal areas with hard-wood floors and that non rubber-soled shoes (especially high heels) are removed before walking on them, that sharp items are not dragged across the wooden floors and that people do not walk across wooden floors with wet feet.

VARIATIONS and DISCLAIMERS

52. FORCE MAJEURE  
 

Villa Surin cannot be held responsible for the consequences of any events outside of our control.

53. INTERNET and SATELLITE CONNECTIVITY  
 

Villa Surin cannot guarantee the permanent connectivity of the internet or satellite services.

54. PHOTOGRAPHS  
 

Due to a policy of constant improvements the actual rooms and furnishings may be different to those depicted on the villa website or in agent photographs of the villa.

55. POWER BLACKOUTS  
 

On rare occasions Phuket is subject to temporary power blackouts.  Such events are obviously outside of Villa Surin’s control.

56. VARIATIONS  
 

Unless otherwise agreed DIRECTLY and IN WRITING with Villa Surin these Terms and Conditions are applicable to all bookings and replace and supersede any terms, conditions or representations made on behalf of Villa Surin by any person or published elsewhere.

Until replaced, these Terms and Conditions are valid for all bookings made on or after 1st August 2011.
